Been debated for a while whether or not we'd have flying creatures.

I thought this was debated a while back here on the Spore forums? I think someone like Dragonspore brought it up and someone else dropped down a screenshot of a flying creature in the background? Eh well regardless I doubt Will would have left it out anyways.

Yeah, I think they've already been confirmed.
What I'm interested in is to see if they will have any underwater creatures; everybody's saying that there's a high chancethey'll drop it...

No, Water creatures are still in trust me, I hope. The stage that got canceled was the molecular stage where you were pretty much bonding proteins together to produce the basic organic compounds for life. It was going to be a "tetris-like" stage that would take around 5-10 minutes of play before you jumped to your celled organism.
Water is still in, I'm pretty sure of it. I don't think Will would remove it considering thats a big part of the evolution portion of his game. But then again... I don't know. They could have removed it to save space on people's hard drives and reduce the pressure on your system trying to render the planet, space, the galaxy, AND underwater...
Let's just cross our fingers, but I don't know how anyone would have gotten that information as the Spore team has been extremely secretive and we dont exactly get a lot of information on the game. So no official announcements have been made on it. I hope not though. (I think people haven't seen it recently like in the old videos so they're freaking out.)
Edit: Been reading around a lot and some people are saying the possibility of water being an Expansion option later down the road should it not be released in the original copy.

It seems to me that they have combined the water level and the microbe level for the tide pool stage. There have been images of cell-like organisms out of the water so it would appear that once your "cell" gets to a certain size, it becomes 3D and moves out of the water.

Yeah...on the Iphone version, It had it on 2D still, but it was more of an ocean background than a micro one...
