I have custom firmware 3.40 oea and i was wondering if i could use cheatsync on it

Downgrade to 3.03 OE-C if you want to use them, that's the latest custom firmware that has been able to use the cheat device.
Yeah 3.03 is the last emulated fw you can run on I believe. weather it's through dev hook or that your limit is 3.03 :) Enjoy cheatsync mate.
